User Agreement for Victory Estimates

Welcome to Victory Estimates! By accessing or using our services, you ("User") agree to the following terms and conditions. This User Agreement ("Agreement") is made effective as of the date of your use of the services between you, the User, and Victory Estimates ("Company"). Please read this Agreement carefully before accessing or using our services.

Scope of Services: The Company agrees to provide the User with the following services:

• Audit insurance company estimates for property damage.

• Prepare a supplement for items not listed or incorrect on the original estimate.

• Submit the supplement estimate to the insurance carrier.

• Follow up with the insurance carrier to ensure approval of the supplement estimate.

Compensation: The Company's compensation for the services provided to the User will be calculated as a percentage of the increased amount approved by the insurance company. The standard compensation rate is 10% of the approved increase. A discount rate of 7% is applied for prompt payment within 21 calendar days of invoicing.

Payment Terms: The User agrees to compensate the Company within 45 days of receiving an invoice for services rendered. Payment is due regardless of the User's success in collecting from homeowners or insurance companies.

Changes to Compensation Rate: Any changes to the compensation rate, other than the standard 10% and the prompt payment discount of 7%, must be agreed upon in writing by both the User and the Company.

Approval and Job Refusal: The User acknowledges that approval by the insurance company is not guaranteed, as each property, damage, insurance policy, and insurance company guidelines may vary. The Company reserves the right to refuse any job submitted by the User.

Confidentiality: Both the User and the Company agree to maintain the confidentiality of any proprietary or confidential information shared in the course of using the services provided under this Agreement.

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Florida, without regard to its conflict of laws principles.

Entire Agreement: This Agreement constitutes the entire agreement between the User and the Company regarding the subject matter hereof and supersedes any prior understandings or agreements, whether written or oral. Any changes to this Agreement must be made in writing and agreed upon by both the User and the Company.

By using the services provided by Victory Estimates, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement.
