User Agreement for Estimate/Supplement Submission

This User Agreement ("Agreement") governs the submission of project details and information ("Estimate") to Victory Estimating & Consulting LLC ("Company") for estimation services. By submitting an Estimate to the Company, you ("User") agree to be bound by the terms and conditions of this Agreement.

1. Service Description: The Company provides estimation services based on the information submitted by the User through the online order form ("Form"), email, or other means. Estimates may include, but are not limited to, category and selector codes, quantities, notes, and any additional information relevant to the estimation process.

2. Accuracy of Estimates: The estimates provided by the Company are generated based on the information submitted by the User. The Company does not guarantee the accuracy of the estimates and expressly disclaims any liability arising from inaccuracies in the estimates. It is the responsibility of the User to review and verify the accuracy of the estimates before relying on them.

3. Transfer of Information: The Company transfers the information provided by the User directly to the estimate without modification. The Company is not responsible for any inaccuracies or errors in the information provided by the User, including but not limited to quantities, materials, and notes.

4. Notes and Additional Information: Users may submit additional notes and information along with the Estimate. The Company reserves the right to include these notes and information in the estimate exactly as provided by the User. The Company does not conduct a formal review or verification of the content of the notes provided by the User and assumes no responsibility for their accuracy or appropriateness.

5. Supplementing Insurance Estimates: The Company may supplement insurance estimates or audit insurance companies for the accuracy of their scope/estimate. It is important to note that the Company does not act as public adjusters and solely aims to obtain a higher "scope" approved. The Company does not deal with policy language or the legal obligations of insurance companies, only the scope of repairs and estimating techniques.

6. No Guarantee of Success: The Company provides no guarantee of success in obtaining a higher scope or approval of the estimate.

7. Right to Refuse Work: The Company reserves the right to refuse work for any reason.

8. Company Information and Logo: Users may provide their company information and logo to be included in the estimate. The Company retains the right to use this information for analytics, research, and business development purposes, which may include improving our services and offerings. We may also utilize aggregated and anonymized data for market analysis and strategic planning. Any use of User-provided information will be in accordance with our privacy policy.

9. Data Retention: The Company may retain the information provided by the User for future use in accordance with its privacy policy.

10. Limitation of Liability: To the fullest extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the Estimate or the estimates generated thereby.

11. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Volusia County, Florida, without regard to its conflict of law principles.

12. Modifications: The Company reserves the right to modify or amend this Agreement at any time. Any such modifications or amendments will be effective immediately upon posting on the Company's website. Users are encouraged to review this Agreement periodically for changes.

13. Acceptance of Terms: By submitting an Estimate to the Company, the User acknowledges that they have read, understood, and agree to be bound by the terms and conditions of this Agreement.
